CallMeChat Billing Policy

Effective date: July 31, 2020

This Policy is a legally binding contract and an integral part to the CallMeChat Terms of Use. All the definitions herein have the same meanings as they identified by the Terms. To find the Terms in full format, you need to follow this link https://callmechat.com/terms-of-use.

1. The Application is being distributed on a paid basis as well as the user’s communication in the Application is carried out for a fee.

2. The paid services within the Website are: (i) 7-day trial and 7-day regular subscriptions; and (ii) internal items as coins. The full description of those services to be identified in special sections of the Website and may be changed by the Company without any prior notification of the users from time to time.

3. The paid subscription allows send and receive messages, use location and gender filters, use coins and gifts, view private images and videos as well as operate other features of the Application as described on the Website.

4. When you buy coins, you can use them to communicate with other users via a video chat embedded into the Website or just show other users your appreciation of them by using coins to send different virtual pics (the “presents”) to other users to attract their attention.

4.1. Both the coins and the presents are digital elements of the user interface of the Website (a kit of images and buttons) the users can interact with. Both the coins and presents are shown to the users as little images within the ordinary user interface of the Website. When the user decides to attract attention of another user by sending them an image of the present, that user has to choose a present and click a relevant image so that another user can see the first user’s reaction and pay attention to that user or just say ‘thank you’.

Neither the coins nor the presents have cash equivalent, monetary or other value, they do not constitute currency or property of any type. In order to avoid any doubts:

• the coins and presents cannot and must not be sold or otherwise transferred to third parties, including other users, cannot be used outside the Website, and cannot be exchanged for cash, any goods or services or any other thing which has any value for any person;
• no users have proprietary, ownership, or monetary interest to the coins and presents, which remains our intellectual property;
• the users must not purchase, sell, barter, or trade any of the coins and presents, or offer to purchase, sell, or trade any of coins and presents (including for money or any other consideration or items of value whether inside or outside of the Website); the users and we recognize that any such attempted transaction will be null and void;
• the coins and presents do not have an equivalent value in real currency and do not act as a substitute for real currency. Neither the Company nor any other person or entity has any obligation to exchange them for anything of value, including, but not limited to, real currency.

4.3. You are prohibited to execute of or solicit in: (a) exchange the coins and presents for money, donation or any other value; (b) request money, donation or any other value for the coins and presents; (c) providing of or request any items, including without limitation, merchandise, services, including without limitation, commercial dating, favors, private conversation, etc. that any person can associate with any monetary value in exchange of the coins and presents.

4.4. The Company reserves the right to modify any digital content within the Website, including, but not limited to, the coins and presents at its sole discretion. Such amendments may impact such content making it more or less common, desirable, effective, or functional.

5. The Company provides the option of automatic purchasing of the coins by prior order of the user. The user may activate the renewal function while providing payment details by checking the relevant box (“Refill your CallMeChat coins balance automatically when to the same amount it drops to 200 coins.”). Once the user activated this option, a credit card will be billed for the last selected Coins package each time the balance is less than or equals to 200 coins. In order to deactivate automated renewals, the user may visit the billing history section in the account menu and press the unsubscribe button. Such opportunity may be offered elsewhere on the Website.

6. The Users may not obtain a refund for the coins and presents due to their online digital nature. The coins and presents are fully consumed by you right after you buy access to it and it is shown to you through the Website. 7. The price of the internal digital features and communication are to be set by the Application algorithms and displayed within the Application. The Company receives a commission. This commission states the fee that the users pay for using of the Application functions.

8. New users may have a chance to see the functions and services in a trial (free) mode (the “trial subscription”). The services and features of the main and trial versions of the Application are identical.

8.1. We may ask you to provide the user’s credit or debit card information when registering for a trial subscription.

8.2. The subscription begins from the date of first payment and renews automatically at the end of each period (each week, month depending on the option selected by you at the time of purchase) until you cancel. Payment will only be charged to your account after the 7-day free trial ends. Your subscription will then auto-renew based on the plan you've chosen unless canceled beforehand.
You can cancel your subscription which means that the automatic renewal will be disabled, but you will still have access to all your subscription features for the remaining time of your then-current period. Simply deleting the app does not automatically cancel your subscriptions. To cancel your subscription either via the settings page in your Account or by contacting us on [email protected]

8.3. The trial subscription is not available to users who have already purchased paid subscription or previously received a free trial and cancelled it prior to paying for the paid subscription.

9. The particular currency and the exact amount you will be charged will be shown to you on the checkout screen before you submit your payment.

10. We are entitled to amend the Agreement as well as this Policy without your prior consent or notification. These changes will be reflected in the Policy placed in the public domain. If you do not agree with changes included in the Policy, you shall terminate the Agreement. Termination results in deleting of your account.
